I do not know whether you know the family involved but this decision strikes me as very possibly unlawful . It is unclear under what nature of occupancy agreement James occupies the property but there should have been a full community care assessment of his needs before a change in the accommodation with which he is provided is contemplated - the mere fact that Oxfordshire is short of cash does not mean that services can be withdrawn without there being such an assessment .
The placement of two individuals in one house might also have been carried out with the grant of some form of tenancy agreement , with a deputy under the Court of Protection , and a person cannot simply be evicted from their home without a possession order and the making of a possession order would be subject to consideration of its proportionality under Article 8 ECHR and as the young man in question is evidently disabled there should have been proper consideration of the public sector equality duty under Section 149 Equality Act 2010 . The family would be well advised to take specialist advice from housing and community care solicitors and as it is the applicant whose means are to be considered he may well be entitled to legal aid .

I look forward to the day when our governments, (of ANY kind) start trying to make life better for the vast majority, instead of threatening to make it less bad than it would be under the other lot.
