The similarity between the relevant section of the melody of The Star Spangled Banner and that of We Wish You a Merry Christmas is both well enough acknowledged and easy enough for anyone with ears and brain in tandem to spot. Still ...

It wouldn't warrant an infringement of copyright claim, we're either or both writhing the relevant time frame.

Now you've got me trying to sing We wish you a merry Christmas in 4/4 time.

Getting back to the supposed similarity between it and the US anthem, it's about as similar as the supposed similarity between the themes from the finales of Beethoven 9 and Brahms 1.

Both in the same key and both in 3/4 time.

I have never met Mr Pee, but I'm convinced that his ears are fine.

Yet he, and apparently you too, seems unable to hear the similarity of melody, while others can.

Each has a sequence of similar length and with similar harmonies, but the melodies are different. You could argue that Moricone's Gabriel's Oboe is like the hymn Praise My Soul The King Of Heaven for the same reason.
