It would hinge on the wording but it's at least arguable that you're right, if it says 'during the performance'...             I can think of several pieces (as i'm sure Bryn can as well) that would lead to an interesting "discussion" as to what exactly constitutes "performance" ........ I've got some MA students who would love to join in

              It isn't given us to know those rare moments when people are wide open and the lightest touch can wither or heal. A moment too late and we can never reach them any more in this world.

                not if you use the guys who advertise on the telly....I think some lawyers miss a trick by not advertising on daytime TV.
