      This is really for Dave 2002 and his original Q primarily...

      English law generally assumes that time of delivery is NOT 'of the essence of the contract', and estimates of delivery time are just that, estimates. If you buy from a shop you can MAKE time of the essence, eg if before you buy you say, "I must have my X by such a date". If the shop say "Yes, we can do that" it is a term of the contract and breach (late delivery) entitles you to revoke the contract and get your money back. But internet ordering doesn't normally allow you to insert such a term...

      Where does this leave you? Contract law in general expects delivery to be in a 'reasonable' time, and the rules of distance selling require delivery inside 30 days from date of contract. Also, bear in mind that distance contracts give you a right to cancel for 7 days, soon (from 13 June) to increase to 14 days, after delivery.

      Once you've placed your order you are generally entitled to revoke your offer to purchase until your goods are despatched (because internet sellers generally say there is no binding contract till goods are despatched), and then from delivery you have the above cancellation rights.

      But NB for CDs, DVDs and software, breaking of any seal on the goods (the transparent wrapping usually) ends your cancellation rights. This is because of the problem of copying digital products - a tad unfair if you can copy them, then send them back a refund!

      BUT NB this only applies on products that are sealed. S/h sellers from Marketplace don't seem to bother to reseal products in order to protect themselves, so in those cases they have no comeback if you try the disc, decide you don't like it and send it back.

      Here endeth the lesson...

          This seems reasonable to me. The consumer would expect a sealed product to be new; the fact that it isn't sealed tells you it's second-hand. If the consumer does what you suggest then the status of the product is still second-hand when it's returned and presumably sold on. Sellers won't be too bothered about this and, as long as goods are as described, neither will the buyer.

          I've had no problem with Zoverstocks either.

            Um, if the consumer has seen the item listed as s/h, they shouldn't be misled if it has been resealed surely? And there's nothing to stop the manner of resealing being different from the genuine new, like a more loose-fitting bag.

            I thought these issues were reasonably clear-cut till someone hereabouts suggested you can order a s/h item off Marketplace and get something clearly new, with labels identifying a shop that's somehow 'recycled' it.
