There is stuff to be wary of here, I think Bryn.

One should , if I read it properly, be very way of downloading the MP3 version before receiving (and possibly playing) the actual CD, especially if, as sometimes happens, the MP3 standalone price is high, or higher than the CD.

Buyer beware, in fact, and especially perhaps on big box sets.
I will not be pushed, filed, stamped, indexed, briefed, debriefed or numbered. My life is my own.

I don't think so. I ordered 6 copies of the CD. I get one free MP3 'rip'.

As it says in that link: "After your order has been completed, the music from the comparable album will be added to your Cloud Player library in MP3 format."

None of the CDs is marked as a "gift" - they are all coming to me. So this term does not apply: "Albums purchased in orders including one or more items marked as "gifts" at purchase are not eligible for AutoRip."

As I say, what I choose to do with the CDs I have bought and of which I have received delivery is up to me

Indeed, as such, I seem to be plumb within the terms of use:

        3. Use of the Service.
3.1 Rights Granted. We grant you a non-exclusive, non-transferable right to use Matched Music only for your personal, non-commercial, entertainment use, subject to the Agreement. We do not grant you any synchronisation, public performance, promotional use, commercial sale, resale, reproduction or distribution rights for Matched Music.

3.2 Playing and Managing Your Music with the Service. You may use the Service only for personal, non-commercial use. You may not use the Service to store, transfer or distribute content of or on behalf of third parties,

If Messrs Sue, Grabbit & Runne would like a tilt, I would kindly invite them to make my day!

Sounds and sweet airs, that give delight and hurt not.
        Sometimes a thousand twangling instruments

Thanks, FHG et al. You might like to know that Denk is playing the GVs live at LSO St Luke's next May, along with the Ligeti etudes.

It loved to happen. -- Marcus Aurelius

Great alert Throppers - many thanks.

I'm very pleased to see in these austere times that May is happening next year - you never know, do you?!

This is where I think Messrs S, G & R might get their claws in. Once you have given away the CD, I think they would argue that the recipient of such gift would constituted such a third party in terms of copyright legislation. Best of luck is you do not retain any of the 6 CD/DVD pairings purchased by you. Not that I expect you, or another in such circumstances, would be detected, let alone taken to law without first being given the opportunity to remove the errant mp3s from their devices.

A case of favour returned. As a result of your post I have ordered the American Mavericks SACD (via the amazon marketplace, so no complementary mp3s).

I think that's a very good point, which I have learnt from this exchange:

"If you cancel your order or return this album, our normal order cancellation and product return policies will apply regarding the physical version of this album. However, if you download any of the tracks on the MP3 version of the album from your Cloud Player library (including if you have enabled auto-download to a device and any of the tracks on the MP3 version of the album auto-download), you will be considered to have purchased the MP3 version of the album from the Amazon MP3 Store (sold by Amazon Media EU Sarl) and we will charge your credit card (or other payment method) for the price of the MP3 version of the album at the time your cancellation or return is processed."

It does happen that I purchase a CD 'on spec' and return it as I don't like it. Haven't done so since the 'FreeMP3Rip' scheme started - but you're right: worth not downloading the MP3s until one's sure one wants the CD.

I've never come across an MP3 that costs more than the CD format - but that's not the point... If I don't want a recording, I don't want it for any money...

There are Plenty of cases where the MP3 costs more than the CD, sometimes appreciably more.

Check the Glenn Gould CD, just as an example.

Not at all . There is no question of copying . As a part of your contract of purchase for the CD you get the MP3 sent to your icloudplayer.

Giving away the CD is not copying it . I agree entirely with my learned friend.

As mentioned over at r3ok.com, the concert went well and a good time was had by all. As to the Diabelli's and the sounds of various historical instruments used for recordings of them, I have six such recordings to hand at the moment. Four (Demus, Komen, Staier and Battersby) use Graf instruments or modern copies thereof. Cooper plays an 1822 Walter und Sohn, and Schiff the Brodmann (c. 1820). These pianists' approaches to the instruments vary greatly. Staier, for instance, utilises all the different bells and whistles his instrument has to offer. Schiff sticks more to the common 'pedals' of the time, making particular use of the una corda. Over the next few evenings I will try to listen to each of the six and comment further. Well, I might skip the Battersby, though it does have the distinction of being the only other such recordings paired with a second using a more modern instrument (a 1976 Steinway D). Come to think of it, I have a second recording (from a Czech radio broadcast) of a concert performance by Staier. I must try and dig that out too.
